Auckland High Court says it's 'commercially unrealistic' to expect Mobil to clean up waterfront contamination

 

Auckland Waterfront loses decontamination battle

The Auckland Waterfront Development Agency has lost its bid for Mobil to pay for the $10 million decontamination of land once used for petrol storage next to Wynyard Quarter.

Auckland Waterfront claimed its tenancy agreement with Mobil required the petroleum giant to leave the site clean, tidy and free from contamination.

However, a judgement delivered by the High Court at Auckland found Auckland Waterfront's claims to be "commercially unrealistic".

Part of the property Auckland Waterfront was redeveloping for mixed residential and commercial use was leased by Mobil from the 1920s until 2011, and was used to store petroleum.

The court said Mobil was entitled to a yet-undecided amount in costs after Auckland Waterfront's case "failed in its entirety".

Not a problem in (un) Clean Green Planet Key as Key has already absolved the oil cos from and monitory or moral responsibility for cleaning up the oil spill disasters they will cause by guaranteeing the New Zealand taxpayer will foot the bill for the clean up; if it is even possible.

How is this clean up that Mobil had guaranteed to carry out "commercially unrealistic" for them after they have made billions through the use of the leased oil storage facility and yet, as the land will have to be decontaminated, it is apparently commercially viable for Auckland Waterfront and the residents of Auckland?

Just a little glimpse of life in New Zealand if Key is allowed to put us in thrall of US corporations by signing the secretive TPPA.
